Insurance event is always a stress for the Insured, and it is extremely important at this situation to get a competent advice from a specialist who is always on your side.

If it is a matter of a loss associated with road traffic accident, then in most cases drivers already know the basic algorithm of actions. In the case of road accidents, there are essentially two options – call the police or issue a European Accident Statement (EAS). But even in such a fairly routine settlement practice, there are a lot of peculiarities that can both help speed up the receipt of insurance indemnity, and vice versa, enable the Insurer to delay with it or even refuse to pay the insurance payment.

The advantages when preparing the EAS are as follows:

  • the speed of registration (there is no need to wait for the police);
  • for the culprit of a road traffic accident there is no need to pay a fine and court fee, to lose a driver’s license even temporarily;
  • for the injured person, the period for obtaining the indemnity from the Insurer of the guilty party is significantly accelerated (there is no need to wait for an extended certificate or a court decision). It seems that all parties are in winning.

But when registering the EAS it is worth to take into account both the specifics of its filling in and the limitations as per cases when its registration is possible (the slightest violation during registration may lead to a refusal to pay), as well as the possible availability and conditions of other insurance policy (in particular – CASCO).

So, in our practice, very often there are cases when the Insured person has a CASCO policy, but the limit of registration of road accident without a police certificate under the CASCO policy is much lower than the limit of the EAS, for example – UAH 20000 in comparison with UAH 50000 as per the EAS. In this situation, the registration of the EAS can lead to the fact that the Insured person will receive an indemnity amount than much less than he expected – after all, he will not be reimbursed more than UAH 20000 under CASCO policy, and as to CMTPL policy the estimated cost of the damage is almost always less than the actual repair amount.

When there are significant losses, for example – losses under property insurance policy, the peculiarities which may arise are significantly more, and the practice and the experience of the clients (Insured persons) is much less. Indeed, when there is a loss the amount of which is calculated by millions, the insurance companies carefully study everything up to the last point in the documents provided by the client. And the correct algorithm of actions in respect of the damage caused to the same property can be very different and surely it depends on different character of damage. So, considering the terms of the insurance policy for fire, flooding or natural disaster the general documents are the insurance event application form and the calculation of the amount of the property to be replaced. And this is not to mention the fact that the list of exceptions under the policy wording should be treated very carefully.

For example – a fire due to a short circuit is almost always considered by the Insurer as an exception, and not always the wording of such an exception is obvious. If such an event has occurred, the Insurer may take a position stating that such a fire could only occur if the fire safety standards are violated. And the losses caused by such violations are almost always excluded from the insured risks. The client far from always can understand that a short circuit can actually be caused by a malfunction in the operation of the city’s electricity grids, which cannot be an exception under the policy. But even with an understanding of this point, there remains the question of how to prove this to the Insurer.
